DWI DISMISSED AFTER ALL EVIDENCE SUPPRESSED

Please note-this is an example of the disposition of a recent New Hampshire DWI case. It is by no means a guaranty of any particular result in any other case.

BASIC FACTS: The defendant was stopped after he allegedly violated the New Hampshire law regarding crossing yellow lines.  After the stop, the officer reported that he smelled an obvious odor of alcohol, that the defendant slurred his speech and had balance problems.  The defendant voluntarily submitted to three “field sobriety tests” that he supposedly failed.  He was arrested and charged with DWI.  At the police station the defendant agreed to take a breath test and blew a .14.  He hired Attorney Stevens to fight the DWI charge.

DEFENSE:     Attorney Stevens observed several unusual characteristics about the area of the road on which the defendant was stopped, including an unusual center turning lane.  It appeared that the defendant had not actually violated the yellow line statute at all.  Attorney Stevens filed a motion to suppress all the evidence in the case.  After a hearing and legal arguments, the Court granted the motion to suppress.  The case was dismissed.  As a footnote, Attorney Stevens also obtained a dismissal of this driver’s administrative license suspension for the test result over .08.  The driver never suffered any suspension at all!  

RESULT:       DWI CHARGE DISMISSED!!!
