DWI CASE EXAMPLE: September 22, 2009

New Hampshire DWI laws and penalties are tough.  Here is an example of a recent case victory-a DISMISSAL of a DWI charge involving an accident and “failed” field sobriety tests:

DWI CASE EXAMPLE-BASIC FACTS: Police responded to the scene of a two vehicle accident, at which one of the drivers was hurt.  After evacuating the injured driver to the hospital, the police focused their attention on the remaining driver, who appeared shaken up from the accident.  The officers made contact with the driver and demanded his license and registration.  The driver produced his license and registration and gave it to the officer.  The officer interrogated the driver about drinking based the driver smelling like he had alcohol on his breath.  The driver admitted to drinking two beers earlier in the day.  The officer then requested that the driver to do “field sobriety testing”.  These are maneuvers in which the officer has the driver perform tricks much like those of a circus monkey prior to arresting the driver.  Even drivers who do well on these unusual tasks end up getting arrested and charged with DWI.  Not aware that he could refuse this ritual, the driver submitted to the circus monkey tricks, “failed” them all and was charged with DWI.  The officer’s report described the usual “standardized clues of impairment” heard about during nearly every DWI trial.

This citizen hired Attorney Mark Stevens to represent him at trial.

Please note-this is an example of the disposition of a recent New Hampshire DWI case. It is by no means a guarantee of any particular result in any other case.

STRATEGY: Prior to trial, Attorney Stevens hired Accident Reconstruction and Collision Analysis expert William Closs, who thoroughly investigated the accident scene, and determined the accident was not the citizen’s fault.  Attorney Stevens also discovered that this citizen’s actual blood alcohol level was lower than .08 at the time that he drove!

TODAY’S SCRIPTURE:

Be assured that the trial and proving of your faith bring out endurance and steadfastness and patience.”
